Does the US Military belong to the people or the JCS?

16 Shells is in possession of a Top Secret Document that is about to inflame the tinders left holding Congress and JCS together.

CJCS Bradley Reala, in a document distributed to the JCS and subsequently signed by them, has given the Military a Green Light to proceed with JCS War Strategy, even if without Federal Funding, and regardless of how Congress acts with respect to this funding.

Realla writes, “Congress decided to pass an amendment in their(sic.) Constitution that changed who leads the military.”

Yes Congress did this. Your Congress. The elected one.

Realla continues, “In their(sic.) Constitution they attempted to define who could and could not lead the military.

Yes Congress does this. Your Congress. The one elected to.

Realla implores the JCS, “Congress does not have the right to define who leads the military, you guys do.”

Actually, this is precisely what Congress has passed laws allowing them to do. So strictly Constitutionally, Realla is wrong.

Realla concludes, “On the eve of a major invasion they threatened to cut our budget completely. In return we have decided to go it alone. Despite Congress, we have decided to (proceed with JCS War Strategy) anyway, with a budget or without one. The eUS Military will continue to do what it has always done... defending the eUSA.”

In other words, your eUS Military is being conscripted privately by the Joint Chiefs of Staff.

16 Shells is not taking a position to judge the actions taken by Congress. They are elected to be Stewards of our Budget. This is what they have done.

Now their decisions are LAW.

Doesn't this make any actions by the JCS to usurp control back from congress a lawless act?

Again, debate the rightness or wrongness of Congress' actions elsewhere.

My question is this simple: By LAW, who has control over the Military?

It is true that Congress has made a direct run at reformatting the organizational architecture of Military, JCS (or perhaps MoD), and how it is funded.

This is a far different thing than saying that Congress is stripping eUSA of her Defense.

Perhaps the story in all of this will end up being about who chose these particular congressmen who are doing this work.

Congress represents the people of eUSA. They act because the citizens have empowered them to do so. If they act irresponsibly, we vote them out. But act they do. And their actions become Laws.

We follow laws. The other choice is Anarchy. And Anarchy by a group (such as Congress or the Military) has a special name: Particularism. And Particularism is unconstitutional.

The question is this: who is engaging in Particularism? Is Congress acting Lawlessly? Is JCS acting Lawlessly?

And what should rank and file soldiers do if their orders are considered lawless under the Constitution?

Why is this important to every eUS Citizen? Because your tax dollars are funding the experience points every Military person earns through serving you in Defense. Militias fund their own Battle Experience Points. The eUS Military gains its Battle Experience Points at your expense, as they should. You need to care whether you as a voter get to participate in how that money is spent. Congress is your only vehicle for doing so.

Our next President will surely have his hands full with this one.
