I offer my opinion to you on this.
Firstly, with my IG hat on, as current commander-in-chief, in effect the Constitution of eAustralia affords the Carte Blanche authority to the Country President (PM) to do as they will with respect to the eAustralian military forces.
In other words, it is technically within the right of the PM to decide to exclude a particular individual if they so choose.
This particular action has NEVER been undertaken in eAus before. But, conceivably, it could have. For example, had Pizza The Hut been in the forces, the CP could have undertaken such action. Also, had a PTO group or individual attempted to infiltrate, this could also been done.
It's not about the legal right. That is well established.
I'm going to keep my personal views on this issue somewhat to my own.
Senate of course can elect to do what it will in terms of attempting to change the law. If it is changed, then I shall uphold that also (at least for as long as I am asked to).
But, and it's a big BUT. I worry for where we are heading with this. Out of my over 2 years in this game, I have never seen this kind of dissent in Senate between the Executive. I think there is one main issue here that needs to be remembered.
We ARE a democracy. Discrate (DD) was, for good or ill, elected as the CP of this country. I do agree with much of the view that as such, and as it was not in any way proven it was under illegal means, this means he is your selected representative.
I as a citizen do not mind debate. Heck I work for the RL gov, and to be frank this shite is pretty vanilla in comparison.
But, I would urge the detractors to use democratic means to raise your issues, and seek your outcome.
Do not threaten to create a situation of military unrest.
Do not mean to fragment our population any further than it already is.
Use proper, democratic means to argue your point, or achieve your goals.
And for gods sake....

As the Prime Minister of eAustralia and the commander in chief of the ADF i have issued the order that Timeoin be banned from the ADF and any other government organization due to his deliberate attempts at destroying the government and the country. He is on the same level as Indonesian PTOers.
I am taking this course of action in the best interest of the eAustralian people.

As a Senator I am trying to amend the Constitution so that it's wording does not conflict with the Military Act on the duties and concerns of the CP versus the Military Marshal. I would prefer to avoid any conflict between the Executive Govt, Senate and our Military if it can be avoided.
Nice and all Ranger. But i think you are forgetting the fact that the CP cannot just remove someone they do not like from the ADF. They have no authority over a decision like that. If he wanted rid of Timeoin it should of been brought up with the Military Council. Like it is suppose to be. But instead Discrate decided to neglect ADF protocol and do this action.
Its hardly appropriate for the CP to overull all of his ADf commanders and sack a soldier without notice, just because he doesnt like him. At the very least I eblieve that legally the CP only has the power to order the Chief of the Defence Force to carry out such an order within the ADF structure.
In doing what he has done and in the way in which it was done, has brough even more shame to discrate and the current executive.

These two paragraphs are incongruous on the exercise of authority.
THe ultimate question is this:
Does the Constitution grant the CP/PM the powers of Commander-in-Chief ad infinitum (Latin: 'without limit') - or does it place caveats on the actor? There are no limits as far as a strict text reading is concerned.
By all means, debate and pass an amendment for later action. However, right here and now, two questionable acts have taken place: 1) Contravention of the Constitution; and
2) A threat to our national security by subversion
Both need to be dealt with. On military matters during my time in eAus, no legislator nor citizen has dared sought to curb the
military authority of the Prime Minister. Though it's difficult to find realistic conclusions to hypothetical (non)events, one would comment that it's improbable even in the event of rank-and-file command override that any PM would be brought to task over it. The suggest itself is mere treasonous and seditious.
Really the point is that it is such seriously bad form for the CP to randomly start sacking soldiers and if he and his cabinet dont realise the consequences of such silliness, they well deserve those consequences.

The military act, under section I, also establishes a clear chain of command with the PM/CP at the absolute top. It does not state the PM can not undertake this action either.
Point is moot I think.

The ADF needs to be a completely separate entity, using it to play political games is just nonsense.
