Federal Act
on the Foreign Nationals


The Federal Assembly of the Swiss Confederation,

desiring to codify rules regarding the subject of immigration of foreign nationals to Switzerland,

decrees:

Chapter 1 Subject Matter and Scope of Application

Art. 1 Subject Matter

This Act regulates the procedure of allowing foreign nationals Swiss citizenship and removing obstacles in their integration into the Swiss community.

Art. 2 Scope of Application

This Act applies on foreign nationals only until full integration into the Swiss community.
This Act does not apply if provisions regulated by other Swiss law or international treaties signed by Switzerland are in force on certain fields of this subject.

Chapter 2 Admission Requirements

Art. 3 Longer Period of Stay

Foreign nationals who apply for a longer period of stay must comply with following requirements:

a. they cannot be nationals of countries considered enemies, which include countries in war with Switzerland and countries members of an enemy political, military or economic block;

b. they cannot apply with a goal which threatens Swiss national security;

Foreign nationals who do not belong to a category of nationals mentioned in Art. 3, paragraph 1, letters a and b, can apply for Swiss citizenship without being rejected automatically.

Art. 4 Shorter Period of Stay

Foreign nationals who apply for a short period of stay must comply with following requirements:

a. they cannot be nationals of countries considered enemies, which include countries in war with Switzerland and countries members of an enemy political, military or economic block;

b. they cannot apply with a goal which threatens Swiss national security;

c. they cannot apply with the goal to be active in Swiss politics.
Foreign nationals who intend to extend their stay must put a notification about their decision described previously.

Foreign nationals who extend their stay in Switzerland must comply with requirements described in Art. 3, paragraph 1, letters a and b.

Art. 5 Asylum

A political asylum can be given to foreign nationals.

In a case of a political asylum application, foreign nationals must comply with admission requirements described in Art. 4.

In a case of a political asylum application, foreign nationals do not need to comply with admission requirements described in Art. 3, paragraph 1, letter a, and Art. 4, paragraph 1, letter a.

Chapter 3 Admission Procedure

Art. 6 Notification of the Federal Assembly

Members of the Federal Assembly will be notified about new applications for Swiss citizenship in the shortest time possible.

Any member of the Federal Assembly or the Federal Council can notify the Federal Assembly about new citizenship applications.

Art. 7 Screening

A citizenship application, as soon as the Federal Assembly is notified, is subject to a screening procedure.

The screening procedure involves:
a. open discussion on the subject of compliance with admission requirements described in Art. 3 - 4;

b. open discussion on the subject of approving the citizenship application.

The screening procedure ends in the moment when members of the Federal Assembly agree or disagree on approving a citizenship application.

Art. 8 Admission

A foreign national is given Swiss citizenship after approval by the Federal Assembly following the screening procedure described in Art. 7.

When a foreign national is given Swiss citizenship, provisions regulated by this Act stop applying for the mentioned national until full integration into the Swiss community.

Chapter 4 Integration

Art. 9 eRepublik modules

Foreign nationals who received Swiss citizenship cannot be subjects of any integration blockade in the political, economic, military, social or other eRepublik modules.

Art. 10 Information

Foreign nationals who received Swiss citizenship cannot be subjects of any information blockade considering events happening in the Swiss community.

Art. 11 Rights

Foreign nationals who received Swiss citizenship are equal in rights and obligations as other Swiss citizens.

Art. 12 Integration Period

Foreign nationals who received Swiss citizenship are considered fully integrated into the Swiss community when the interest of Switzerland is their top priority.

Chapter 5 Revocation of Rights

Art. 12 National Security and Admission Requirements

Foreign nationals who received Swiss citizenship are subjects of revocation in rights and obligations of Swiss citizenship in case they threaten national security and do not comply with admission requirements described in Chapter 2, Art. 3-4 of this Act.

Art. 13. Scope of Application

Foreign nationals who received Swiss citizenship and who are subjected to provisions described in Chapter 5, Art. 12, are completely excluded and isolated from the Swiss community, complying with other Swiss law.

Art. 14. Reintegration

Foreign nationals who received Swiss citizenship and whose rights have been revoked can be reintegrated into the Swiss community if they comply with provisions mentioned in Chapter 2, Art. 3-4 of this Act.

Art. 15 Period Before Revocation

Foreign nationals who received Swiss citizenship can be subjected to Chapter 5 only to the point of their full integration into the Swiss community.

Chapter 6 Amendments

Art. 16 Compliance with Swiss law and International Treaties

This Act complies with other Swiss law and international treaties signed by Switzerland.

Fields not regulated by this Act are regulated by other Swiss law and international treaties signed by Switzerland.

Provisions from other Swiss law or international treaties signed by Switzerland, in case they regulate subjects described in this Act, have supremacy over provisions of this Act.

If provisions from this Act collide with provisions described in other Swiss law or international treaties, this Act is subject to amendment.

Chapter 7 Validity

Art. 17 Approval

This Act needs to be approved and signed by the Federal Assembly and the President of the Federal Assembly, respectively.

Art. 18 Cancellation

This Act can be cancelled by the Federal Assembly at any time it sees fit.
