With Limits, Judge Allows Abortion Law in Mississippi

A federal judge in Mississippi partly lifted a barrier on a law on Friday that would put new restrictions on the state’s sole abortion clinic. But he blocked parts of the law that could expose the clinic to criminal or civil penalties while it tried to come into compliance with the new restrictions.

The law, which the State Legislature passed in the spring, requires physicians performing abortions at a clinic to have admitting privileges at a local hospital. The two doctors who perform abortions at the state’s only clinic, in Jackson, do not have such privileges. Although they have applied to seven hospitals in the area, they have yet to hear a response.

The clinic sued the state, and on July 1, the day the law was to take effect, Judge Daniel P. Jordan III of United States District Court temporarily blocked the measure. The judge held a hearing on Wednesday to decide whether to keep the law blocked.

The state argued that the hold should be lifted because the administrative process for carrying out a new law can take up to six months, during which the clinic would be allowed to operate as it tried to come into compliance.

Lawyers for the clinic responded that during that administrative process the doctors would still be breaking the law by performing abortions and could possibly face criminal prosecution, even if they later met the law’s obligations.

Judge Jordan’s decision, which addressed both concerns, did not address the fundamental constitutional dispute: whether the law is, as the clinic argues, simply a pretext to stop abortions in the state altogether. Allowing the law to take effect, the judge said on Wednesday, would allow him to see whether or not the doctors would be able to comply with its new regulations. The outcome of that process would have an impact on determining the law’s constitutionality, he said.

The West Nile Virus has claimed the life of a Mississippi resident. Now state health officials are warning you to be extra cautious.

The death was in the town of Raleigh on the Smith and Rankin County line. No details have been given on the person's age or identity.

Other local cases have been reported in Hinds, Rankin, Yazoo, and Lincoln Counties.

"It's important to protect yourself from any mosquito bite," says Dr. Paul Byers, the Acting State Epidemiologist. "Because we don't know, and you can't look at it and tell which one is going to be infected."

Dr. Byers tells us over the years, West Nile has popped up in just about every Mississippi County. Right now is peak season.

"When you go outside, it's important to use appropriate mosquito repellent," he says. "It's also important to avoid those times of day when we know that the types of mosquitoes that transmit this infection are most active."

That's the early morning and late evening when it's cooler outside. And remember, mosquitoes thrive in standing water.

"We know that this mosquito can breed in very small amounts of water, even the amount of water that's in a flower pot sitting on your porch or your deck," says Dr. Byers.

The very young and people over the age of 50 are most susceptible to West Nile. The doctor says most healthy people who get the virus get over it and show no symptoms. Others have flu-like symptoms and also beat West Nile. But a very small percentage of people aren't so lucky.

"They can have some neurological symptoms, can give you a Paralysis, it can cause Meningitis, Encephalitis. So it can be pretty serious in some individuals," says Dr. Byers.

The bottom line is to protect your skin, and if you suspect you've been infected, visit your doctor immediately.

Last year there were 712 reported cases nationwide. 43 people died from the West Nile Virus.

It was more than a millennium ago when the West Nile Virus was first heard about and identified. This original was able to subdivide itself into two different classes. The first class of WNV infected a lot of people across the globe but it was the most virulent in Africa. The second class of WNV was at first found to have infected horses in Madagascar and Africa. Later on, it also infected horses found in Europe. In Hungary, it became a epidemic among numerous horses. These happened during the year 2008.

The West Nile Virus is very virulent. It has cost a lot of people their lives. In fact, several historians have proposed that Alexander the Great died at a young age because he succumbed to the West Nile Virus. The basis for this was that numerous birds died prior to him getting sick and it should also be noted that WNV also infected avian animals.

With some advancement in technology, scientists were able to segregate the West Nile Virus during the year 1937 in Uganda. During this year, the country was plagued with the yellow fever virus leading them to isolating another virus altogether. Because of these, scientists were able to study the West Nile Virus and they were also able to quantify the percentage of people who tested positive to WNV infection. These countries were Congo, Sudan, Egypt, and India. The numbers were highest in Egypt. The study revealed that 90% of those aging 40 years old were infected with the West Nile Virus. In 1957, it was discovered that WNV infection is the major cause of a severe form of meningoencephalitis. Countries on the western hemisphere as well as in the US were first found to have been infected with the WNV virus during the year 1999.

Why Some Memphis Homeless Shelters Charge Money


(Memphis) Craig Parker said he hasn’t been homeless for years but his heart is still there with the people, “I want people to know how the homeless people in this city are ignored.”

He says one thing needs to change for sure, how homeless shelters in Memphis charge people to spend the night, “If you aren’t working and have no money, how can you pay to get in?”

One of several places that charges a fee, is the Union Mission on Poplar.

“I have people call me up and say ‘I can`t believe you charge those people!’,” said Director of Development Steve Carpenter.

Carpenter says the mission allows people to stay four nights a month for free, after that there is a $6 a night fee.

He said it’s not a way for the mission to make money, it’s more about helping the homeless be accountable for their lives, “There is a fine line that you have to walk between serving people and enabling them.”

Carpenter told us one way a homeless person doesn’t have to pay for a bed at night, is to enroll in one of its long-term programs,“So there is no charge for those programs and those folks are with us for a very extended period of time.”

Right now, he says, those programs are full.

Parker told us that leaves many on the streets with few options/

“Where are they going to go?” he asked. ”They end up on the corner of Cleveland and Poplar asking somebody who walks by for a dollar, which is a crime in this city.”
