Dear citizens. I was so amazed when I suddenly got a 4000 BEF incoming donation on my private account. It came from Elynea.
She said me she had quit the MoEducation and asked if I would refund the BTA subsidy. She clearly acted in good faith since I am the former Minister of Economy/Finance and she trusted me before with payments to the state. She should imo be left out of further reading.
I sent to GoopyPants, the new MoFinance, the proposal to give 13/30 (1733 BEF) of that amount to the state and 17/30 (2267 BEF) back to Elynea. I explained that since the subsidy was paid on Day 1370, 17 days ago, it seemed fair that Elynea should keep a proportional part for the number of days served.
I will not post GoopyPants' reply here, since it would be against the forum laws. But I can tell you it was rude. He injuncted me to hand over all 4000 BEF.
What would you do in that case?
I immediately donated Elynea 4000 BEF back as a private donation so she can continue BTA activities without being hindered financially. I think that is the main point.
- The BTA Law, as it was in effect on Day 1370, stated that the BTA received 4000 BEF, no strings attached.
- The law does not say anything about justifying expenses or about pro-rata refunds after a mid-subsidy-term resignation.
[edit]Since I had my forum access removed (temporarily), I am not able to ask the Supreme Court (edit)(where GoopyPants held one third of the vote, but he should have resigned now) for an opinion, which I would accept and follow.[/edit]

Why did she donate to you in the first place and not the state. She got the money since she was MoE. As soon as she is not the MoE, she should return all of the money and it is not up to you to decide how much the state should get back etc. I really do not understand why she sent you money and you being the middle man.
I think Goopy made a great point and in the end, the money should be returned to the state so that the state and fund the MoE for the food program.
The donation is done given to the MoE, but to the BTA 😉.
There is actually nothing that should go to the MoE, unless he's in charge of the BTA.

It's not state money: it's money given to the BTA, according to law, on Day 1370.
MG wants me to reveal a private PM from GoopyPants to prove that GP was rude and threatening. Only the SC has the power to do this under forum laws. Suffice it to say that GoopyPants says me to "expect most congress members to view that as theft, however" if BTA kept the money that was given to it NO STRINGS ATTACHED.
I did an amicable proposal to settle this with a pro-rata payment - since it's refused, only Justice can force me to pay.
Elynea effectively gave me 4000 BEF, so she is willing to repay. But it's her money, not the state's anymore. So why should she repay it?
For me it's simple: the new MoF/CP extort/steal our citizens already.
@MG: quite disrespectful to have a forum discussion in which I cannot even defend.
On the #eBrussels irc, GP advised to "never mind about that transfer, MG" - strange to see different advice elsewhere.

It's done, they have now NO CRITICISM about me.
As SC member, I'll react on the matters that concern the SC:
1) GP indeed has a vote in the SC. I see no reason why he should resign, as there is no current case involving him. Rest assured that in any case where one of the judges is involved, he/she WILL step down from that case.
2) The SC aims for justice. That implies justice for all eBelgian citizens, also during a ban from the forum. You can send me or one of the other justices a PM with a case if you want to raise one. Please do specify which illegal act was performed. I'm willing to PM you the Criminal Justice Act when required.

The PM of controversy............................... If elynea wants to keep the money, she should post that on the forums. Expect most congress members to view that as theft, however.
If funds were spent and distributed, that's one thing, but pro-rating it as a salary again would most likely be viewed disfavor ably by the congress.
If you have the funds now, would be better to transfer them and then find out I'd elynea is entitled to a portion. Otherwise folks may view you as improperly holding state funds. ................................

@Boklevski: I wrongly thought that SC members could not hold another public function. Calling for GoopyPants' resignation was indeed, based on what I can find now on the public part of the forum, premature.
@Goopy: you say keeping money from the state is theft. Since the 4000 BEF is not owed to the state, the accusation of theft is unfounded, and rude.
don't worry Ward, the lead of the BTA is jofroi now. They have their money... now i'm free of their law.
if we look what elynea spend since day 1370 for the BTA, we see that this much more then this 4k.
Cause Elynea is one of the most integer persons I know and has her pride, she has donated the 4k of this month entirely to the state. This is actually HER own money she has used now, to let people stop complaining.
This is certainly a misunderstanding and I hope that my government will do everything in their power to correct this (=donate Elynea these 4k)
Wait, so the issue is that Elynea indeed spent the 4000 BEF budgeted as part of the FfNC program on day 1370 on the program after day 1370, then decided to give Ward 4000 BEF of her own for Ward to give to the state?
Or is it that she has, on he own, spent far more than that prior to day 1370, and is owed at least 4000 BEF, even if she didn't spend any funds of her own or of the state's after day 1370?
If it is #1, then it was a voluntary donation to the state and clearly could not be viewed as improper use of state funds. But that wasn't what was presented originally not indicated until now.
In the form of food, yes, since she never even saw the 4000 BEF.
The transaction of Day 1370 was: 4000 BEF from MoF (NBB-BN😎 -> CP Critically, who bought food for it. He gave that food to Elynea, who then donated it to the BTA members.
Why on earth should she refund 4000 BEF that she has ever seen??

Why didn't you ask earlier, Xironn? Spent or unspent, in the form of food or in the form of money, it's her 4000 BEF. Justice was done in the end. Thanks for Belgium.
