Considerando:

- La historia de eCuba
- La necesidad de tener un sistema de defensa adecuado y constante contra invasiones externas, o emergencias internas.
- La seguridad y tranquilidad del pueblo.

Este Gobierno en acuerdos con el congreso propone la siguiente:


LEY DE EMERGENCIAS

1. El Estado tiene la obligación de mantener un fondo de reserva (o Fondo de Emergencias) para ser utilizado únicamente ante emergencias según lo estipulado en el Capítulo II de la ley.

2. El Fondo de Emergencias no será menor al costo de una liberación de dictadura, más 50 mil cc.

3. El Gobierno podrá decidir durante su mandato si el Fondo de Emergencias será mayor, pero no podrá decidir que el fondo será menor al estipulado en el artìculo 2

3.1 El Gobierno podrá aumentar el Fondo de Emergencias hasta 7 días antes de las siguientes elecciones presidenciales.
3.2 El Gobierno podrá aumentar el Fondo de Emergencias si cuenta con los siguientes requisitos: Las ganancias del período son mayores al aumento propuesto; cuenta en las arcas con el nuevo mínimo más el total del costo de 4 MPPs; y obtiene el apoyo del 50%+1 del congreso.
3.3 El Gobierno no podrá aumentar el Fondo de Emergencias por más de 10k durante el mes de su mandato.
3.4 El Fondo de Emergencias no podrá ser aumentado si alcanza el valor total de 4 liberaciones de dictadura.

4.- El Gobierno podrá bajar el mínimo del Fondo de Emergencias si cuenta con el apoyo de ¾ partes del congreso, pero nunca podrá ser menor al estipulado en el art. 2

5.- El Gobierno deberá suspender o recortar todo plan social de ayudas, y no podrá firmar más de 3 MPPs mientras las arcas sean menores al estipulado en el artículo 2



Capítulo II
Sobre el Estado de Emergencia

6. Una Emergencia podrá ser determinada si:

6.1 Existe una amenaza a la seguridad nacional que pueda ser demostrada.

6.2 Para determinar una emergencia, el Congreso propondrá la necesidad de activarla y será con el apoyo del 66% de los congresistas cuando se apruebe. En el caso que por los diferentes motivos no hubiera congreso, se formará una comisión integrada por los PP de los partidos top 5 y los comandantes de las MU´s Top5 que serán los que aprueben la emergencia con el 66% de los votos

6.3 La comisión excluirá a quienes no sean ciudadanos ecubanos y a quienes hayan obtenido la ciudadanía o nacidos hace menos de 3 meses, tomando los siguientes partidos y MU´s hasta completar la Comisión en 10 personas

6.4 En caso que el CP no tuviera responsabilidades sobre la emergencia será parte del Comité



Capítulo III
Sobre el Uso del Fondo de Emergencia

7 El Fondo será guardado en la ORG “Banco Central de Cuba” u ORGs oficiales.

8. En Estado de Emergencia, inmediatamente después de declararse la Emergencia, El Congreso, o si no hubiera, en su defecto el Comité de Emergencias, decidirá la mejor forma de utilización del Fondo de Emergencia.


9. En caso de golpe de estado externo se dispondrá del fondo automáticamente e inmediatamente después de la creación del Comité de Emergencias.

10. El Comité de Emergencias podrá determinar en votación express de 24 horas o si alcanza acuerdos el cese o inicio de la utilización de los fondos.

11. El Gobierno en conjunto con el Comité de Emergencias determinará el momento del fin del Estado de Emergencia.

This government with agreements of the Congress proposes the following:


EMERGENCY LAW


1. The State has an obligation to maintain a reserve fund (or Emergency Fund) to be used only in emergencies as provided in Chapter II of the law.

2. The Emergency Fund will not be less than the cost of a liberation from dictatorship, plus 50,000 cc.

3. The Government may decide during its mandate if the Emergency Fund will be higher, but can not decide that the fund will be less than that stipulated in Article 2


3.1 The Government may increase the Emergency Fund up to 7 days before the next presidential election.
3.2 The Government may increase the Emergency Fund if it has the following requirements: Earnings for the period are higher than the proposed increase; account in the coffers have the new minimum total cost plus 4 MPPs; and gets the support of 50% + 1 of the congress.
3.3 The Government can not increase the Emergency Fund for over 10k during the month of his term.
3.4 The Emergency Fund may not be increased if it reaches the total value of 4 liberation of dictatorship costs.

4. The Government may lower the minimum Emergency Fund if it has the support of three quarters of congress, but can never be less than that stipulated in art. 2

5. The Government shall suspend or cut any social aid plan, and may not sign more than 3 MPPs while the coffers are lower than that stipulated in Article 2



Chapter II
State of Emergency

6. An Emergency can be determined if:

6.1 There is a threat to national security that can be demonstrated.

6.2 To determine an emergency, Congress propose the need to activate and it will be with the support of 66% of congressmen when approved. In the event that for various reasons there are no congress, a committee will be formed with the PP of the top 5 parties and Top 5 MU commanders may approve the emergency with 66% of the votes.

6.3 The Commission will exclude those who are not ecuban citizens and those who have obtained citizenship or born less than 3 months ago, taking the following parties and MU's to complete the Commission with 10 people

6.4 If the CP has no responsibility for the emergency, he/she will be part of the Committee



Chapter III
On the use of the Emergency Fund

7 Emergency Funds will be stored in the ORG "Banco Central de Cuba" or Official ORGs

8. With the State of Emergency, the Congress, or if there were no Congress, the Emergency Committee, will decide the best to use the Emergency Fund.

9. If external coup automatically and immediately the fund will be available after the creation of the Emergency Committee.

10. The Emergency Committee may decide in an express vote of 24 hours or if it reaches agreements cessation or commencement of the use of funds.

11. The Government in conjunction with the Emergency Committee will determine when the end of the state of emergency.
