If someone has attacked a region before you and beaten the garrison to conquer it you'll have to declare war on them and then re-attack the region to claim it for yourself. Bear in mind, however, that if their attack fails then you'd have a much easier task of then taking on the defenders yourself.

wait, is it possible to upgrade your units and invade a region at the same time?
All leader units have a physical unit, so they can move if you wish. You cannot upgrade a unit and use it the same turn.

No, you can never exceed your caps. You'll be locked into a war for a minimum of 2 turns, therefore you will not gain additional slots until the minimum 2 turns elapse.

OK no worries attacks take longer than I thought, in that case I won't build the extra troops but I'll upgrade my barracks to lvl 2

When one of the now rebel controlled areas are invaded, I will agree to a one time swap of the colours.

You cannot exceed your cap at any time. You'll be locked in a war for a minimum of 2 turns, therefore you cannot recruit any new units until you seize a new region or units or you lose the war for the new region.
