Today I was banned from the private Dails of the forum by an admin for saying something "vulgar". The admin is not the CC or LCC so this is past his means and he is clearly a power hungry c**t who hates me because I made him look retarded a while ago.This admin, who we will referrer to as "Dubhcakes" is upset that I took advantage of his idiocy (he published his IRC pw in a thread DERP) and I logged in as him.Until I am freed from this unjust exile I will report from my office here: http://ieforums.hobbittown.com/default.aspx?g=posts&m=44785post44785

Dub is clearly abusing his power, but its ok because people want to suck up to him and PP is unpopular. It doesn't matter that this issue makes the whole country shit or anything, it's ok to power abuse if the person you're attacking is unpopular.

The Ceann Comhairle and Leas Ceann Comhairle elected by Dáil members are the sole moderators of the Dáil Chambers and associated sections. This is according to legislation enacted by the Dáíl covering these duties.
I feel this ban is a dangerous example of outside forces attempting to moderate the Dáil on a permanent basis without any official sanction by the Dáil whatsoever.
For our society to work together we must have a community that can abide by the methods our proud nation has adopted. Unfortunately Dubh did not even bother to write the legislation or consult the Dáil prior to assuming and enforcing powers which Dáil has not provided to him.
I can see where Sean is coming from. This is a new forum and we must be vigilant.

PP may be trolling Dubh but there is merit in what he is saying and this ban gives a real reason for our citizens not to sign up.
These are national forums and they need to obeyed to a firm rule structure.

You will find most of our active players are already on the forum and posting away. The rule structure needs to be followed by all concerned and I agree, each side need to do it.

Dubh has not been empowered by the Dáíl to carry out the function of moderator in the Dáíl not to threaten people with bans and have them enforced (not sure if you clicked the relevant buttons). His act was illegal and unconstitutional.
Whether PP deserves the ban or not is not my issue... but rather that the one tiny spectrum reserved to the Dáíl (Organising itself offsite) has been usurped and trampled upon by Dubh in an abrupt and heavy-handed manner.

He banned him from the forum, the dail was just a small part of the overall ban. He cant be banned from the forum and left to have access. Me, Dubh, Dan and Kav can ban people from the forum.
By that logic Sean, he can post anything he wants outside the dail and we cant do anything. Cause you cant do anything outside of the dail so are we meant to just leave him?

Couldn't a usergroup be created to allow TDs access to the Dáil even if they lose their privileges to another section. Historically Dáíl access has been within the sphere of competence of the Dáil (and extraordinary situations requiring Presidential involvement)
Allowing Dubh to ban PP, without any involvement of our democratic institutions and without any legal authority, is a dangerous precedent to set. That system is wide open to abuse, hidden from the public, unaccountable and unnknown. How do people go about "impeaching" Dubh as admin if he breaches proper mod standards?
This is not about the action taken (which tbh was abit ott imho) but about having a fair, accountable and democratic procedure for moderation within the confines of our nations democratic parliament.

Upon further cooling down (despite Padraig Pearse harrassing me in IRC, and threatening to shoot my family in a forum thread) I have come to the conclusion that banning Padraig Pearse for his conduct in the Dail was premature and overstepping my boundaries. For that I apologise.
However, there does need to be clarification of who has what powers, and where. Whilst the CC and LCC are not specified as the sole moderators of the Dail (just like its not legislated that people can post in it), historically that is how it has been. CC's and LCC's cannot currently ban people or modify their access rights, so if some punitive measure was required they would need to ask another to carry it out - breaching the same 'precedent' that I did.
Whilst I am a vehement advocate of free speech, I fail to see how calling every member a shower of cunts is more encouraging to a new player, than the peaceful silence we are now experiencing in PP's 2 day ban. In fact since I stepped up and challenged the argumentative, bitchy and hateful conduct in the dail, we have had more daily posts than before, whilst poor behaviour has almost disappeared.
Try and work out who the real 'baddie' really is here.

Dub may have overstepped but he said he was sorry. To be honest I didn't have a problem with what he did. I am not a prude, I am a big boy, but unlike many on here I have children at home who occasionally look over my shoulder. For them to see vulgar filth written on here is totally unnecessary. If PP can't express an opinion or a simple sentence without such language then I feel sorry for him. And just saying " It is just PP. Let him have fun." is like saying " It's just Jack the Ripper. He kills prostitutes. It's what he does. Just ignore him." We are adults ( well most of us are ) so maybe we should act like adults.

Freedom of speech is the concept of the inherent human right to voice one's opinion publicly without fear of censorship or punishment. "Speech" is not limited to public speaking and is generally taken to include other forms of expression. The right is preserved in the United Nations Universal Declaration of Human Rights and is granted formal recognition by the laws of most nations.
Nonetheless the degree to which the right is upheld in practice varies greatly from one nation to another. In many nations, particularly those with relatively authoritarian forms of government, overt government censorship is enforced in some form, and there are different approaches taken to issues such as hate speech, obscenity, and defamation laws even in countries seen as liberal democracies.
So despite the fact that Dubh overstepped his authority to enforce censorship, in the Public & Private Dail, we still need censorship in some form to deal with events such as this.
Best add in: CC and LCC are solely responsible for the Dail, but the Dail is only part of the forums - not the entire structure. It would be arguable that Dubh has not overstepped anybody's authority as there isn't an authority clearly given the role of moderation. Dubh made use of the forum mechanics he had to block out bad language - which I'm sure no one is objecting too (Even PP doesn't seem to argue that the ban was not justified, but disagrees Dubh should have been the one to give it).
So I can make it black and white: No Swearing in the forums. A team of moderators set up to edit out bad spelling, give warnings to offenders, work with a point system to remove bias, and ban given out for set amount of points. Repeat offenders get a longer ban.
Sorted. Now on to more important matters!
