[HoC] GOVERNOR SBP CORRUPTION TRIAL

Dear Citizens of ePakistan,
It has been over 7 days since the Governor of the State Bank of Pakistan had been notified. The congress had requested the Governor of State Bank of Pakistan, dodial, to give the Congress reasoning behind his unconstitutional actions. His actions reflected mistrust upon the elected CP TheJakal and mistrust on us all, the congress and the cabinet. He was accused of looting the treasury of Pakistan and without notification or approval of the CP or the Minister of Finance, the governor of the SBP has gone missing with the finances that belong to the people of ePakistan. We had notified and summoned the Governor, yet he has rejected our requests. I, Shin Gouki, Head of Congress of ePakistan, hereby suspend him as the Governor of SBP and relieve him of his duties. With the disciplinary powers vested in me and the judicial rights of the congress, the accused has been barred from retaking any government position until he is cleared off these accusations.
I also summon him for the last time to defend his case, the inability to do so will result in conviction and being labeled the enemy of state. I request the congressmen of ePakistan, the Country President, the Prime Minister & Minister of Finance and Chief of Army Staff to attend the hearing. The hearing shall take place on Sunday Night, Day 1825 or 18th November at 10:00 PM.

Congress has no constitutional powers to try citizens of the state; get it right, you're not the judiciary. Neither do you posses the powers to bar anybody from office.
Don't call stuff "unconstitutional" if:
1. That's the same shit you're doing.
2. You don't know what the constitution states.

Policy you fail to understand what the NAC comprises of.
And you fail to understand the powers the NAC has through the constitution of ePakistan.

The constitution doesn't give you the powers of a Judiciary; quit trying to worm around it. And my previous statement stands - please, find logical reasoning with constitutional evidence why it wouldn't.
Chapter 4 Article 24
Section 2 e: Minister of Finance Powers
i. Minister of Finance has the power to develop the budget for ePakistan and allocate the spending of funds and identifying the source of revenue.
ii. Minister of Finance can give the approval to Governor of State Bank in regards use of funds according to the budget with permission of the President.
iii. Minister of Finance has the power to question any state bank activity which has not been approved by the Government and may report such activity to National Accountability Committee
Article 26
Section 2. President should approve the use of money in consultation with Minister of Finance by preperation of proper budget.
Section 4. The National Accountability Committee of Congress should perform regular audits and if any trace of corruption in regards to State Bank’s money is found it should be investigated.
Section 5. Upon Investigations made by the National Accountability Committee. Governor shall be removed by sentate by 66% agreement

Article 28. Judicial Powers
Section 1. Senators and NAC of Congress shall be entrusted with Judicial powers.
Section 2. Senate can hear proceedings of any proceedings initiated against any individual or members of government and members of the congress.

as far as i have understood the constitution only NAC members of congress have judiciary powers so you as head of congress cannot suspend him
and also NAC can only investigate corruption .Senate then does the hearing and pass the sentence .

Besides, you haven't mentioned how the President can interfere in the affairs of the elected legislative body; unless I'm missing something (which I doubt). QE😨 What 'judicial powers' does the HoC have?

Senate should be elected to serve a term of 3 month by congress members and country president known as senate electoral college.
Mohammad Bilal never carried out senate elections. Hence the Senate is non-existent presently.
So I hope that answers Chaudary Muhammad Azwar's question, when there isn't a Senate, does it mean that the role of law remains non-existent in ePakistan?
The Constitution written by Ahsan Shabaz is erroneous. It has errors which themselves block us from removing them.
Article No. 35 Presentation of the Amendment bill
Bill shall be open to discussion for 3 days during which congress members can raise objections on first Presentation.
if no objections to the bill has been raised it shall be subject to a vote.
If a vote is passed with ⅔ majority bill should be brought in-front of council of elders who shall conduct a vote on this.
If council of elders approve with ⅔ majority the bill become part of the constitution
if recent the bill shall stand rejected
So, the congress or any congressman presents a bill which requires a law or an article or clause of the constitution to be changed. The bill is open to discussion for 3 days during which congress members can raise objections on first presentation. Lets suppose we pass through this and the bill receives approval by 2/3 majority. Explain to me how the bill will be brought in-front of the Council of Elders when it was dissolved by the previous government?
Having said this, we were the first members of Senate, we fulfilled our 3 month terms and the person who wrote the constitution defied it by arguing about clauses. You argue about a constitution which consists of major errors and is forcing the recovery of State Funds.
The Congress exists, the senate does not, and neither does the council of elders. The congress is united about actions to be taken against the person who unlawfully took away 800+ gold from ePakistan, the government for a change is active as ever and is generating income and moving forward. Yet Policy who demands to be Prime Minister and Chaudary Azwar who decides to further push obstacles in front of our efforts into bringing the state funds back. What are we supposed to do?
Abide to the constitution written by Ahsan Shabaz? The article which itself allows us to amend is the article which is stopping us from doing so. Do you want Dodial and his buddies to consume the gold? Is that the case? If yes, please let you intentions be clear. Have a referendum and let the people vote.
I'll share a telephone number with everyone, whoever wishes to vote can call and verify their identity and be eligible to vote. You can see for yourself then how many multies are being run by whom and where ePakistan is headed. And if this is about being given a chance to be a PM, then no, work hard for it and win it yourself. Don't ask for free rides. I give this game time and I'm doing something which won't benefit me as an individual and will benefit the ePakistanis of tomrorow.

What powers does it give you? Who are you to judge the actions of someone who is elected to legislate?
If I as an individual claim that the constitution is erroneous and I declare it to be void, is there anything you can do about it apart from argue? It would be my word against yours. You will say no, I will say yes. How old are you? I just showed you the constitution has errors and you're asking me if i'm questioning something which has flaws? I've never asked to to be Prime Minister, nor any position in Government. My last article testifies to this -- I was offered the position by Jakal, and refused it.

All you've done is re-iterate my point. The constitution itself -- and especially, in its codified structure -- is flawed for eRepublik; hence, it doesn't work. Furthermore, "Judicial Powers" and the "powers of a Judiciary" are two very different phrases -- as would be established by rules of language; and it also is self-conflicting, i.e., does it refer to the 'right to be tried by one's own peers', or the Senate as a Judicial body? Neither does it specify a penal code.
Also, the NAC is supposed to be already filled by congress; - that is, my individual members of congress, not the body in its entirety. I guess congress could always vote in members to it, but that's a congressional matter - Jakal has NO authority over congress.
I also appreciate your satirical metaphoric comparison - except that it is not wholly factually correct.
Policy, How do we get beyond this argument? What is the solution? I propose all parties be taken into confidence and a new constitution be formulated. Something simpler and something efficient enough. Ahsan proposed the senate and proposed the constitution. The moment Mohammad Bilal became CP he resigned the next month in order to become MoFA. This constitution makes life very hard upon all those need to legislate and I personally think that judicial powers or not.
But coming back to it -- you, as Head of Congress, have no "Judicial Powers" -- that exists with the Senate as a body (to define "Judicial Powers" is a completely different arguement, and I'd have to undertake a comprehensive research on the sources Ahsan used -- apart from the RL Pakistani Constitution -- to write the econstitution). So you can't really do anything much, of substance.
The CP was elected by the people, its not our fault the "Governor" of SBP was asleep and isn't willing to accept this government. It doesn't give him the right to take away government funds and fail to explain his position to the people. It disappoints me that some of our senior most players are quiet on the issue and these care takers of ePakistan are enjoying bonuses while we do hard work and try to generate funds for MPPs and Supplying the newer players.

We've brought the arguement back to full circle. I've already told Jakal multiple times on what to do, I even linked him to the terms which I was using so he could read up on them - but he seemingly hasn't done so, and it's been several days.
Imo, as I told Jakal, the solution is in a semi-codified constitution -- that is, an uncodified constitution without prerogatives, convention, etc. You on IRC by any chance, btw?

Yeah, pretty much. The current constitution is inadequate, and it's the main reason I refused to ever create a constitution for Pakistan (I was asked to do so, before); it's un-needed, too many rules for a game.
Also, Jakal's mandate is within the constitution, and he doesn't really have anything legally to over-step that. Unless we want to be all quasi about it, naw mean.

Article 23 Section 4:
Senate has the power to appoint Governor of State Bank of ePakistan for indefinate term by 66% agreement.
According to the constitution, the Governor of State Bank of ePakistan requires 66% Senate Votes?
He was never elected nor did the Senate ever vote, let alone him getting 66% Senate Votes.
