Tras los debates realizados, en español y en inglés, sobre la revalidación de la Constitución de Cuba, se procede ahora a realizar la votación por medio de la cual la comunidad cubana decide si la actual norma es definitivamente ingresada como la carta magna de toda la sociedad bayamesa.

Las reglas serán las siguientes: Se requerirá una mayoría absoluta (la mitad más un voto del total de votantes) para la aprobación, reprobación o regreso a debate de la norma, para lo cual se habilitan las opciones "Si", "No" y "En Blanco" respectivamente. Para votar, solo deberá dejar un comentario en ste artículo con la opción de su preferencia. Por supuesto, se verificará la ciudadanía cubana antes de validar el voto hecho, y si ninguna de las opciones obtiene la mayoría requerida, se efectuará un nuevo escrutinio entre las dos opciones más votadas en donde ganará la que tenga mayor votación. Finalmente, la duración del escrutinio será por 72 horas (esto es, mientras el presente artículo se encuentra publicado en primera plana).

El pueblo Cubano, en libertad y en ejercicio de la soberanía nacional, proclama la siguiente

CONSTITUCIÓN DE CUBA

TÍTULO PRELIMINAR
Disposiciones generales

1. La República de Cuba se constituye en un Estado social, democrático, participativo y de Derecho, que se organiza en régimen de Libertad y de Justicia.
2. La soberanía nacional reside en el pueblo Cubano, instituído en la Asamblea Nacional Cubana, de la que emanan los poderes del Estado.
3. Es ciudadano cubano todo jugador que tenga la ciudadanía cubana en eRepublik. La condición de ciudadano se pierde con la pérdida de la ciudadanía.
4. Los derechos y deberes de los ciudadanos son iguales, irrenunciables, irrevocables e intransferibles.
5. La República de Cuba incorporará a su derecho positivo aquellas normas internacionales que fuesen aprobadas por el Gobierno y ratificadas por la Asamblea Nacional, así como las Leyes de eRepublik y promoverá su cumplimiento.

TÍTULO I
Fundamentos sociales, políticos y económicos del estado

6. Se instituyen como derechos fundamentales de los ciudadanos todos aquellos vinculados a su dignidad humana.
7. La participación de los ciudadanos en la administración y ejercicio de los poderes del Estado deberá ser en posición de supremacía sobre los poderes del estado.
8. No podrán ser fundamento de discriminación de ningún tipo el ejercicio de los derechos fundamentales, así como la naturaleza, la filiación, el sexo, la clase social o las ideas políticas o religiosas.
9. La creación y participación de los partidos y asociaciones políticas será libre dentro del respeto a la ley.
10. El acceso a la cultura es un derecho fundamental del pueblo cubano, en consecuencia, corresponde al Estado la tutela cultural del país, así como su promoción e incentivo.
11. El Estado tiene libertad y obligación de hacer uso de todos los mecanismos económicos a su disposición para promocionar la economía nacional y la financiación del Estado.

TÍTULO II

La Asamblea Nacional Cubana

12. La Asamblea Nacional Cubana es la reunión de todos los ciudadanos cubanos.
13. Un reglamento emanado de la misma Asamblea establecerá sus mecanismos de funcionamiento y gestión interna.
14. Es competencia de la Asamblea Nacional Cubana:
14.1. La aprobación de las leyes orgánicas que fundamentan el Estado.
14.2. La ratificación de las leyes aprobadas por el Congreso que no tengan una correspondencia ingame.
14.3. La aprobación y ratificación de la adhesión a tratados internacionales.
14.4. La aprobación y ratificación de tratados de paz.
14.5. La aprobación y ratificación de Pactos de No Agresión propuestos por el Gobierno.
14.6. La ratificación de grandes planes económicos, bélicos, sociales o de cualquier índole, que entrañen una gran incidencia en el momento de su aprobación o en el futuro sobre la ciudadanía o el Estado.
14.7. La aprobación del Reglamento de las Fuerzas Armadas Cubanas.
14.8. La destitución de cualquier miembro del Gobierno, excepto la del Presidente.
15. La Asamblea Nacional Cubana ejercerá la tutela del Gobierno y el Congreso.
16. La Asamblea Nacional Cubana tendrá derecho de veto, por aprobación de dos terceras partes de los votos emitidos, sobre las leyes y actos emanados del Congreso y el Gobierno que no requiriesen la ratificación de la Asamblea Nacional Cubana.

TÍTULO III
El Congreso

17. Son congresistas todos los ciudadanos democráticamente elegidos en posesión de su cargo en eRepublik.
18. Un reglamento emanado del mismo Congreso establecerá sus mecanismos de funcionamiento y gestión interna.
19. Es competencia directa del Congreso:
19.1. La aprobación de las leyes. Son potestad exclusiva del Congreso la aprobación y ratificación de todas las leyes ingame salvo aquellas en las que una ley orgánica o la Constitución estipulen expresamente lo contrario.
19.2. La ratificación de las leyes orgánicas aprobadas por la Asamblea Nacional Cubana.
19.3. La aprobación y ratificación de Pactos de Protección Mutua propuestos por el Gobierno.
19.4. La aprobación y ratificación de declaraciones de guerra y de enemigo natural.
19.5. El ejercicio de las potestades atribuídas a la Asamblea Nacional Cubana cuando estas entrañen un peligro para la seguridad nacional.
19.6. La aprobación y ratificación de los presupuestos presentados por el Gobierno y la vigilancia de su cumplimiento.
19.7. La ratificación del Reglamento de las Fuerzas Armadas Cubanas.
19.8. La aprobación y ratificación destitución del Presidente del Gobierno.
20. Corresponde al Congreso la supervisión directa del Gobierno de Cuba.

TÍTULO IV
El Gobierno

21. El Gobierno lo compone el Presidente del Gobierno elegido democráticamente y todos los miembros de su ejecutivo designados por él.
22. Son competencia del Gobierno todas las tareas ejecutivas y todas aquellas que pudieran surgir en el ejercicio de su función y que no estén atribuídas a la Asamblea Nacional Cubana o al Congreso. Son de especial competencia del Gobierno:
22.1. La comandancia y dirección de las Fuerzas Armadas Cubanas.
22.2. La elaboración de unos presupuestos para la legislatura en que gobierne cada ejecutivo.
22.3. La propuesta de adhesión a tratados internacionales, declaraciones de guerra, de enemigo natural, pactos de protección muta, pactos de no agresión y la gestión de las relaciones internacionales.
22.4. La aprobación de grandes planes económicos, bélicos, sociales o de cualquier índole, que entrañen una gran incidencia en el momento de su aprobación o en el futuro sobre la ciudadanía o el Estado.
23. El Gobierno deberá ser garante y cumplidor de lo dispuesto en la Constitución y en las leyes. En consecuencia, el Gobierno deberá:
23.1. Hacerse cargo de la promoción económica, cultural y social de Cuba.
23.2. Respetar y cumplir los compromisos constitucionales de participación democrática, en especial, aquellos que tiene para con la Asamblea Nacional Cubana y el Congreso.
24. El Presidente tiene libertad para hacer las modificaciones en su Gobierno que considere oportunas.

TÍTULO V
Justicia

25. La eventual creación de un Poder Judicial se realizará por medio de una Ley Orgánica aprobada por la Asamblea Nacional, que deberán ratificar el Congreso y el Gobierno.
26. En cualquier caso, los castigos observados por el Poder Judicial deberán ajustarse a los principios de legalidad, irretroactividad, tipicidad, responsabilidad y proporcionalidad.
27. En cualquier caso, se establecen las garantías procesales mínimas: habeas corpus, presunción de inocencia, resolución motivada y derecho a recurrir la resolución.
28. La potestad sancionadora que se establezca por medio de la Ley Orgánica no tendrá perjuicio sobre sanciones administrativas tipificadas por los reglamentos. En cualquier caso, las sanciones administrativas podrán ser recurridas ante el tribunal que establezca la ley, teniendo su sentencia superioridad sobre la sanción administrativa.

TÍTULO VI
Garantías y reforma de la Constitución

29. La Asamblea Nacional Cubana ejercerá como garante de la Constitución sobre todas las instituciones públicas. Aquellos asuntos no regulados por la ley serán objeto de decisión y regulación de la misma.
30. La reforma constitucional compete exclusivamente a la Asamblea Nacional Cubana.
31. La reforma constitucional total o aquellas que incluyan los Título preliminar o Título I se realizará previa aprobación por mayoría cualificada de dos terceras partes de los votos emitidos el inicio de su proceso de reforma. La reforma final de su articulado será aprobada por mayoría simple.
32. La reforma constitucional parcial que no incluyese el Título premiliar o el Título I será propuesta a debate y aprobada por mayoría absoluta de los votos emitidos.

DISPOSICIÓN DEROGATORIA
1. Queda derogada la Ley Fundamental del Estado Cubano.
2. Quedan derogadas cuantas disposiciones se opongan a lo establecido en esta Constitución.

DISPOSICIÓN FINAL
Esta Constitución entrará en vigor el mismo día de la aprobación de su texto oficial por la Asamblea Nacional Cubana. Se publicará también en lengua inglesa.

The Cuban people, in freedom and exercise of national sovereignty, proclaims the following

CONSTITUTION OF CUBA

PRELIMINARY TITLE
General provisions

1. The Republic of Cuba is constituted in a democratic, participatory and legal social state, which is organized under Freedom and Justice.
2. National sovereignty belongs to the Cuban people, instituted in the Cuban National Assembly, from which emanate the powers of the state.
3. Is Cuban citizen every player who has the Cuban citizenship in eRepublik. The condition of citizen is lost with the loss of citizenship.
4. The rights and duties of citizens are equal, inalienable, irrevocable and transferable.
5. The Republic of Cuba will incorporate into its positive law those international standards that were adopted by the Government and ratified by the National Assembly and the Laws of eRepublik and shall promote compliance.

TITLE I
Social, political and economic foundations of the nation

6. Instituted as fundamental rights of citizens all those linked to human dignity.
7. The participation of citizens in the administration and exercise of powers of the State must be in a position to supremacy over state powers.
8. Any form of discrimination in the exercise of fundamental rights as well as human nature, parentage, gender, social class or political or religious ideas, is groundless. 9. The creation and participation of political parties and associations will be free in compliance with the law.
10. Access to culture is a fundamental right of the Cuban people, therefore, it is matter for the State the cultural protection in the country, and their promotion and incentives.
11. The State has the freedom and obligation to make use of all economic mechanisms at their disposal to promote the national economy and the State funding.

TITLE II
The Cuban National Assembly

12. The Cuban National Assembly is the meeting of all Cuban citizens.
13. A regulation issued by the same Assembly shall establish its working mechanisms and internal management.
14. It is competence of the Cuban National Assembly:
14.1. The adoption of organic laws underlying the State.
14.2. The ratification of laws passed by Congress that have no ingame regulation.
14.3. The approval and ratification of the accession to international treaties.
14.4. The approval and ratification of treaties of peace.
14.5. The approval and ratification of Non-Aggression Pacts proposed by the Government.
14.6. The ratification of major economic, military, social or any other type plans, which involve a large effect on the time of approval or in the future on citizenship or State.
14.7. The adoption of the Rules of the Cuban Armed Forces.
14.8. The removal of any member of the Government, except the President.
15. The Cuban National Assembly shall supervise the Congress and the Government.
16. The Cuban National Assembly shall have the right of veto, for approval of two thirds of the votes cast, on the laws and acts issued by the Congress and the Government that did not require ratification of the Cuban National Assembly.

TITLE III
The Congress

17. The congressmen are all citizens democratically elected in possession of office in eRepublik.
18. A regulation issued the same Congress shall establish its working mechanisms and internal management.
19. It is the direct responsibility of Congress:
19.1. The adoption of laws. Are exclusive power of Congress to approve and ratify all ingame laws except those in which an organic law or the Constitution expressly provides otherwise.
19.2. The ratification of the organic laws passed by the Cuban National Assembly.
19.3. The approval and ratification of Mutual Protection Pacts proposed by the Government.
19.4. The approval and ratification of declarations of war and natural enemy.
19.5. The exercise of the powers attributed to the Cuban National Assembly when they pose a danger to national security.
19.6. The approval and ratification of the budgets submitted by the Government and compliance monitoring.
19.7. Ratification of the Rules of the Cuban Armed Forces.
19.8. The approval and ratification of impeachments.
20. The Congress shall direct supervision of the Government of Cuba.

TITLE IV
The Government

21. The Government composes the democratically elected President of the Government and all members of its executive appointed by him.
22. Befalls the Government all executive tasks and all those that may arise in the exercise of their function and are not attributed to the Cuban National Assembly or Congress. The next duties are of special jurisdiction of the Government:
22.1. The command and direction of the Cuban Armed Forces.
22.2. The preparation of budgets for the legislature whose executive is governing.
22.3. The proposed accession to international treaties, declarations of war, natural enemy, mutual protection pacts, non-aggression pacts and management of international relations.
22.4. Approval of major economic, military, social or any other type plans, which involve a large impact on the time of approval or in the future on citizenship or state. 23. The Government should be the guarantor and compliant with the provisions of the Constitution and the laws. Consequently, the Government shall:
23.1. Taking charge of economic, cultural and social development of Cuba.
23.2. Respect and comply with constitutional commitments for democratic participation, especially those having to with the Cuban National Assembly and Congress.
24. The President is free to make changes to his government as appropriate.

TITLE V
Justice

25. The eventual creation of a Judicial Power shall be by means of an organic law passed by the National Assembly, which must ratify the Congress and the Government.
26. In any case, punishments observed by the Judicial Power shall comply with the principles of legality, non-retroactivity, authenticity, accountability and proportionality. 27. In any case, the minimum procedural guarantees are establishe😛 Habeas corpus, presumption of innocence, reasoned decision and the right to appeal the decision.
28. The sanctioning authority established by the Organic Law shall not prejudice on administrative sanctions described by the regulations. In any case, administrative sanctions may be appealed to the tribunal established by law, having its judgment superiority over the administrative penalty.

TITLE VI
Warranties and constitutional reform

29. The Cuban National Assembly will serve as guarantor of the Constitution above all public institutions. Those matters not regulated by law shall be subject to decision and regulation thereof.
30. The constitutional reform is exclusive competence of the Cuban National Assembly.
31. The overall constitutional reform or those that include the Preliminary Title or Title I shall be subject to approval by qualified majority of two thirds of the votes cast in the start of its reform process.The final reform of its provisions shall be approved by simple majority.
32. The partial constitutional reform that did not include the Title or Title I premiliar will be proposed for discussion and approved by an absolute majority of the votes cast.

DEROGATORY PROVISION
1. Is hereby repealed the Basic Law of the Cuban State.
2. Is also hereby repealed any provisions contrary to this Constitution.

FINAL DISPOSAL
This Constitution shall enter into force on the date of approval of its official text by the Cuban National Assembly. It was also published in English.
