Just a short socratic piece.
Proposed by some:
The criminal law must all be based on written laws.
Congress makes the written laws.
Congress gets its authority to make the written laws from the written constitution.
(good so far)
The written Constitution doesn’t have any mention of Congress’ power to write criminal laws.
Hmmmm….philosophic difficulty?

Lol, the problem with this "debate" is that some people are being deliberately obtuse rather than actually reasoning about what is right and wrong.
In a discussion between two men, one of whom is trying to make things clear and the other one of whom is trying to make them appear confused and muddled, the advantage is strongly with the latter.
Rigour6 just summed up human history in a sentence.
