Appropriate Content Standards / Content Restrictions
No content, service nor Merchant Product made available using the Payment Service may include any (a) material that is harassing, defamatory, libelous, abusive, threatening, obscene, or coercive; (b) material that violates the rights of any person or company protected by copyright, trade secret patent or other Intellectual Property Rights or similar laws or regulations; (c) material that Service Provider knows, or should have a reasonable basis to know, is derived from services or sites that permit illegal peer-to-peer sharing of copyrighted content; (d) material that disparages AT&T in any way; (e) materials that are sexually explicit, or relate to tobacco, alcohol or gambling; (g) material that would constitute "junk mail" or "unsolicited bulk e-mail," or other advertising material or communications to persons or entities that have not specifically agreed to receive Messages from Merchant; or (h) materials that include or introduce malicious programs into End Users’ equipment including, but not limited to: viruses, worms, Trojan horses, e-mail bombs, cancelbots or other computer programming routines that are intended to damage, interfere with, intercept or expropriate any system, data or personal information, including executing any form of network monitoring that will intercept data not expressly approved for use.


This is  a pilot program with a scheduled end date of June 30, 2011. It may be terminated or extended at the carriers discretion. Merchant must:

1.Comply with all Applicable Laws, rules and regulations applicable to Merchant Products made available using the Payment Service
2.Never include a surcharge to the wireless subscriber for use of Mobile Billing, including surcharges in the form of any merchant offers or purchases where a Mobile Billing user would receive less merchant value (e.g., fewer virtual coins or less merchant virtual currency) than the subscriber would otherwise have received if making the same dollar amount purchase utilizing any other payment type, including but not limited to, credit cards, bank cards, or
3.Comply with the MMA Guidelines and AT&T Consumer Experience Policy (CEP), including the provisions related to subscriptions, advertising and promotion, and inappropriate content [summarized in this document]
4.Comply with the Content Restrictions described above, and 5) maintains terms of use for purchases of Merchant Products through the Payment Service (collectively, “MERCHANT TOU”), which the Service Provider will include in the Payment Page MERCHANT TOU (available at http://www.zong.com/help/terms). At a minimum, any and all MERCHANT TOU’s must comply with MMA Guidelines and must meet such other requirements as AT&T and Service Provider will mutually agree.
5.Merchants shall refrain from using affiliated marketing to promote Merchant Products.





Consumer Refunds
If an AT&T consumer contacts the Merchant for a refund for any reason, consumers should be redirected to Zong customer care (unless the original issue is resolved by Merchant’s customer care representative and the consumer no longer seeks a refund). Merchants are NOT allowed to issue refunds directly (via check, PayPal, ACH, etc.) Merchant should provide consumer with all of Zong’s customer care methods:

No Use of Free
In connection with any Internet-based purchase of Content subscriptions by an End User, the following is prohibited: The use of the terms “free,” “complimentary,” “no charge,” “without charge,” or any other term that reasonably leads a customer to believe that he or she may receive something of value, entirely or in part without a requirement of compensation in any form, or that tends to convey the impression to the consuming public that an article of merchandise or service is “free,” unless the Initial Representation to the customer clearly and conspicuously states that the free item may be received by a customer pursuant to his or her authorization of billing for a paid subscription plan, the price of the plan, and its term. For example, a free game subscription offer requiring a customer to subscribe to a monthly subscription plan at a cost of $9.99 per month shall say, “Unlimited free game play with paid monthly subscription of $9.99/month.”

Chat and Social Networks Policy
All social networking and chat applications or games which allow communication between users will be responsible for all of the safety tools below. Merchants shall adhere to the following safety guidelines by conducting regular and ongoing audits of their social networking and chat applications or games.

All social networking and chat applications or games are required to have the following:
An age acknowledgement tool at registration that successfully determines if the user’s age is appropriate, and blocks access if he or she does not meet the set age requirement
A minimum age of 13 is required for all non-romance themed games and applications
A minimum age of 18 is required for all romance and dating themed games and application

A ‘Report Abuse’ function must be made easily accessible to the user with clear action provisions outlining how complaints will be responded to.


Inappropriate Content
The use of inappropriate content in SMS campaigns is not permitted. Below describes AT&T’s position on inappropriate content. Campaigns that offer inappropriate content may be terminated on AT&T Mobile Payments billing. AT&T Reserves the right to classify any material as inappropriate.

Content is generally considered “Restricted” if it contains any of the following restricted content identifiers:
Intense Profanity
Intense violence
Graphic depiction of sexual activity or sexual behaviors > Nudity
Hate speech
Graphic depiction of illegal drug use

Any content that has not been classified as “Restricted Carrier Content” will be considered “Generally Accessible Carrier Content” and will be subject to be available to all consumers.


Profanity
Use of profanity in products is strictly prohibited. Lyrics, Wallpapers, Song Titles, alerts, and moderated interactive communications containing profanity must be removed. If a particular piece of content is incomplete without using a profane word, it is permissible to offer this product only after the word have been altered to be less profane (i.e. Sh*t)


Drug Use
Any reference to the abuse of alcohol, drugs, tobacco or other controlled substances is strictly prohibited. This includes verbal and non-verbal actions in which a person could conclude that promotion of drug use is intended.


Sexual Conduct
Content of adult nature is not allowed. Adult nature includes sexual explicit images and textual communications that are sexual graphic.

Sexual Explicit Images:
No exposed breast or genitalia either cartoon or real, is permitted to be offered.
No images meant to insight sexual activity may be offered. This includes images depicting any sexual act.

Textual Communications:
Any controlled communications between a Merchant and consumer must not contain content that could be considered sexually explicit. Content directed at encouraging sexual acts or to excite a subscriber in a sexual way is not allowed through these Mobile Payments services.
