Anti-Corruption Law

Chapter I
Scope and definitions

Article 1.
This law applies to officials and former public officials, whether Ministers, Governors, or the President. In general, all agencies, services or state entities, as well as those non-state public person..

Article 2.
For the purposes of this law is meant by public officials, those workers who perform functions in one agency of the State, which can represent any authority there, whether legislative, executive or judicial.

Typically these are government agencies, Congress, Ministries, the Civil Service and, in general, all those agencies that do not belong to the private sector.

Article 3.
For the purposes of Chapter II of this Law is meant by corruption misuse of public power or public office for economic gain for himself or for another, has been consummated or not harm the State.

Chapter II
Congress Argentina.

Article 4.
The Congress, in addition to fulfilling the tasks stipulated in Chapter V, Art. 25, of the Constitution Policy of the eRepublic of Argentina , also deal with:

1) To receive and investigate complaints about the irregularity of any government agency, which referred to in Chapter I.

2) Prepare a report which was submitted for debate in Congress to determine the guilt or otherwise of the officer.

3) To determine a sentence, which will be brought to a vote.

Chapter III
Social Control

Article 5.
Public Agencies will widely publicize their purchases of goods and contracting services, according to guidelines established by the Executive –or the hierarchy organization, in which case- to regulate this law.

Article 6.
The Government will carry out regular campaigns in terms of transparency and public accountability of public officials, as well as crimes against public administration and citizen’s control mechanisms.

Article 7.
The acts, documents and other items relating to the civil service may be disseminated freely, except that by its nature, must remain secret or reserved or have been accepted as such by law or substantiated resolution. In any case, under the responsibility to that there was place by right.


Chapter IV
Criminal Provisions

Article 8
Penalties:

1) Any public official who, with or without deception, either directly or through an intermediary person, interesare in order to obtain an undue advantage for himself or a third party in any act or contract, will be removed from office and punished with a fine ranging from 25 Golds to 200 Golds. In case of not having money to pay the fine, will be confiscated -to election- its goods.

2) Any public official who abusing his capacity as such or the position he plays, compel or induces any promise or give him or unduly a third party, any money or other benefit, shall be punished by a fine ranging from the 25 golds to 300 Golds. In case of not having money to pay the fine, will be confiscated -to election- its goods.

3) Any public official who, with abuse of his duties, reveals facts, publishes or disseminates documents that jeopardise national security, known by him or possessed by virtue of their current or previous position, which must remain secret, or facilitates their knowledge will be fined for an amount ranging from the 50 golds to 200 Golds. In case of not having money to pay the fine, will be confiscated -to election- its goods.

4) Any public official who, took advantage of his position and take money (Gold or ARS), the national coffers (National Treasury, Central Bank, Ministry, Provincial Coffers, or any public institution) will have to repay all the stolen, plus a fine ranging from 100 to 500 Gold golds. In case of not having money to pay the fine, will be confiscated -to election- its goods.

Article 9
Fines will be duplicated in the event that the culprit, refuses to comply with the ruling or fails to comply with the time stipulated by Congress, which would require the terms of Chapter VI , Art. 13.

Chapter V
Administrative Aspects

Article 10
Civil servants should strictly observe the principle of probity, which involves a functional conduct honest in his tenure with the public interest precedence over any other.

The public interest is expressed in the satisfaction of collective needs on a regular and ongoing basis, in good faith in power, in the impartiality of decisions taken in carrying out the powers and duties functional in the righteousness of their exercise and the proper administration of public resources.

Article 11
Civil servants observe the principles of respect, fairness, honesty and competence and avoid any behaviour which amount abuse, excess or misuse of power and misuse of his office or his intervention in matters that may benefit economically or benefit persons connected directly with them.

Any act or omission in contravention of this article will incur its perpetrators in any administrative, civil or criminal, in the manner prescribed by the Constitution.

Article 12
They conduct contrary to probity in public office:

1) The use of office to influence a person in order to achieve a direct or indirect benefit for himself or a third party.

2) Take a loan or under any other form of money or property of the institution, unless expressly authorized by law.

3) Intervene in decisions on matters that fall has participated as a coach. Staff members must make known to his superior his implication in these matters, so that it adopts the corresponding resolution.

4) Using their own benefit or third classified or confidential information which has become known in exercising its powers.

Article 13
In the event that the person found guilty of the offence, would not satisfy the judgement in the stipulated time, after having been reported this, will be to inform Admin, which is responsible for fulfilling the judgement.
