Hello everyone! I have wonderful news!



The Sakura Constitution is completed! This is a heavily edited version of the Reiji Constitution formatted to fit our times and our needs, and if this constitution is approved by the ruling government, it will become law and become the standard at which eJapan is governed in the new age! This constitution will come to recognize a new era of partnership between both sides of our political spectrum, and become the primary tool to weave us together despite our past transgressions, and to bring us all back to the table of dialogue after so long of living in a split nation.

For all of those who aren't leadership in a political party, I highly encourage you to please post constructive criticism and comments about this document below, and to carry on the discussions elsewhere in your own spaces! And for those that are part of the party leadership, I encourage you to join us on the forums of the United Lolies of Japan for a moderated convention on finalizing our constitution!

Chapter One: General Principles

Article 1. The State of eJapan is a democratic society led by its people. All power in the State belongs to the people.

Article 2. The Diet of Japan and the Office of the President are democratically elected by the rightful citizens of eJapan.

Article 9. The armed forces of the State of eJapan belong to the people.

Article 4. The State of eJapan must maintain an environment viable for positive commerce.

Article 11. This Constitution shall be the supreme law of the nation and no law, ordinance, National rescript or other act of government, or part thereof, contrary to the provisions hereof, shall have legal force or validity. The treaties concluded by eJapan and established laws of nations shall be faithfully observed.

Article 12. No one person shall enjoy exceptions from the laws and provisions issued and guaranteed under this Constitution.

Article 12. The Shogun or the Country President, as well as Ministers of State, members of the National Diet, and all other public officials have the obligation to respect and uphold this Constitution.

Chapter Two: The Fundamental Rights of the eJapanese Citizen

Article 1. All persons holding the citizenship of the State of eJapan are equal before the law. Every citizen enjoys the rights and at the same time must perform the duties prescribed by the Constitution and the law.

Article 7. eJapanese citizens shall enjoy freedom from discrimination from all classes, including from areas such as sex, race, ethnicity, religion, nationality, class, sexual orientation, and gender identity and expression

Article 8. eJapanese citizens shall enjoy the liberty of speech, writing, publication, public meetings, demonstrations and associations, within the limits of the law without inciting libel or slander

Article 9. eJapanese subjects may present petitions to members of the State organs. Citizens have the right to make to relevant complaints and charges against, or exposures of, violation of the law or dereliction of duty by any state organ or functionary. No one may suppress such complaints, charges and exposures, or retaliate against the subjects making them. Citizens who have suffered losses through infringement of their civil rights by any state organ or functionary have the right to compensation in accordance with the law.

Article 11. The State of eJapan protects the legitimate rights and interests of Japanese nationals residing abroad and protects the lawful rights and interests of returned overseas Japanese

Article 12. The exercise by subjects of the State of eJapan of their freedoms and rights may not infringe upon the interests of the state, of society and of the collective, or upon the lawful freedoms and rights of other subjects.

Article 13. Citizens of the State of eJapan must abide by the constitution and the law, keep state secrets, observe public order and respect social ethics.

Chapter Three: The Shogun

Article 1. The State of Japan shall be reigned over and governed by a ruling sovereign henceforth called the Shogun installed by the people. They shall act as the Head of State.

Article 2. The Shogun shall be the symbol of the state and of the unity of the people, deriving his position from the will of the people with whom resides sovereign power.

Article 3. The shogun shall reign until their abdication or forced vacation of the National Throne. Their replacement shall be determined by the people through election.

Article 4. The Shogun shall be elected by the sovereign people of the State of eJapan.
--An election commission, consisted of one representative from each political party in eJapan excess of five members, shall be responsible for endorsing candidates for Shogun through a two-thirds majority of the committee
---Voting shall take place in a manner accessible to all citizens of the State of eJapan not requiring membership in any other apparatus except eRepubik
---The current reigning Heads of State and Government may not hold seats on the electoral commission.
---The electoral commission shall be chaired by a representative whose military unit and associated party does not have a potential candidate for the National Throne.

Article 5. The Shogun is the head of State, combining in them the rights of sovereignty, and exercises them, according to the provisions of the present Constitution.

Article 6. The Shogun must comply with the rulings of the government. They must unconditionally comply with the rulings of the Country President and National Diet, and work in concert with the Country President and the National Diet to finalize legislation into force as it is approved.

Article 7. The Shogun exercises no legislative power. The Shogun must not exercise any power delegated to any other apparatus of the State of eJapan without prior authorization from the parties that hold those powers.

Article 8. The Shogun is not allowed to establish candidacy for any political office.

Article 8. The Shogun shall preside over the National Diet, and convokes, opens, closes, and prorogues it.

Article 9. The Shogun shall act as the cultural and spiritual leader of Japan, in the place of the Emperor, and has the ability to issue National Ordinances pursuant of this mandate in the place of law.
---Such National Ordinances are to be laid before the National Diet at its next session, and when the Diet does not approve the said Ordinances, the Shogun shall declare them to be invalid for the future.

Article 10. The Shogun is the highest officer of the military, above and outside the command structure. The Country President has full authority to command the military in the Shogun’s name.

Article 12. The Shogun shall confer titles of nobility, rank, orders and other marks of honor.

Article 13. The Shogun shall receive foreign ambassadors and ministers.

Article 14. The Shogun shall attest to instruments of ratification and other diplomatic documents as provided for by law.

Article 15. The Shogun shall perform ceremonial functions.

Chapter Four: The National Diet

Article 1. The National Diet of eJapan is the highest organ of state power. It serves the people together with the directly-elected executive Office of the President.

Article 2. The National Diet of eJapan is the legislative power of the state.

Article 3. The National Diet shall exercise the following powers
---To vote on proposals issued by the Country President by all present-and-voting members of the National Diet within a twenty-four hour period.
Request the Shogun to approve and deny citizen requests, through private message public announcement
---To propose laws for consideration of the National Diet by all present-and-voting members of the National Diet within a twenty-four hour period.
Those allowed to be regulated through legislation as defined in current eRepublik laws

Article 4. No Member of the Diet shall be held responsible outside the Diet, for any opinion uttered or for any vote given in the Diet.
---When, however, a Member himself has given publicity to his opinions by public speech, by documents in print or in writing, or by any other similar means, he shall, in the matter, be amenable to the general law.


Article 5. The National Diet of eJapan has the power to recall or remove from office the following persons, given a majority vote by more than two-thirds of the present-and-voting representatives over a forty-eight hour perio😛
---The President and Vice-President of the State of eJapan
---The Ministers appointed by the Office of the Country President
---Any ambassador appointed to represent the State of eJapan
---The governor or manager of any state-owned enterprise
---The Shogun, with approval of the Country President

Article 6. Amendments to the Constitution are to be proposed by the members of the National Diet of eJapan and adopted by a majority vote of more than two-thirds of all the present-and-voting representatives over a forty-eight hour period.

Article 7. Statutes and resolutions are adopted by a simple majority vote of the present-and-voting representatives over a twenty-four hour period.

Article 8. Citizens of the State of eJapan may speak in the Diet at their pleasure, without voting rights. Officials of the Office of the President share the same privilege.

Article 9. If the Country President is sympathetic to a Shogun who has violated the Constitution of the State of eJapan, the National Diet is authorized by any means necessary to organize a revolution against the Shogun as well as an immediate Impeachment of the Country President.
---At the conclusion of the crisis, a new dictator should be elected or democracy should be maintained, approved by a two-thirds majority of all present-and-voting members of the National Diet over a forty-eight hour period

Article 10. The National Diet may respectively present addresses to the Shogun.

Article 11. All members of the National Diet must be active members of the official government social apparatus to have a vote on all legislation

Article 12. All members of the National Diet must propose legislation on the official government social apparatus in order for such a law to be considered by the State.

Chapter Five: The Office of the Country President

Article 1. The Country President (henceforth referred to as President) of the State of eJapan is elected by the people and shall act as the Head of Government.

Article 2. Citizens of the State of eJapan who are eligible according to eRepublik citizen laws are eliglible to be elected President.

Article 3. The President may exercise the following powers:
---Promulgates statutes of the government
---Create and dissolve ministries and commissions of government
appoints and dismisses the Ministers of State and their personal cabinet
---Proclaim a state of war and issues mobilization orders, after authorization from the National Diet
---Propose new legislation for the consideration of the National Diet
---Propose new Mutual Protection Pacts with other States, to be authorized by the National Diet
---Propose Trade Embargos against other nations, to be authorized by the National Diet.
---Propose Peace Treaties with other States, to be authorized by the diet

Article 4. The President shall receive foreign diplomatic representatives on behalf of the State and shall appoint and recall plenipotentiary representatives abroad.
---The president has the power to assign these duties to a Minister of Foreign Affairs

Article 5. The President ratifies and abrogates treaties and important agreements concluded with foreign states, with the consent of the National Diet.

Article 6. In the event of an Impeachment, the President shall be succeeded in accordance with eRepublik citizen laws.
---In case the offices of the Vice-President or Ministers of the State of Japan falls vacant, the President shall, at his pleasure, appoint a new Vice-President or Minister to fill the vacancy.
---In the event the head of government (President) cannot be filled, the Shogun shall assume the day-to-day operations of the government until a recognized replacement is established

Article 7. The President shall keep the Shogun informed of the day-to-day operations of the government

Article 8. The President shall jointly, with the National Diet, hold the ability to call for a dissolution of this constitution and a return to democracy under the following circumstances:
---The Shogun has vacated or been ejected from their seat and the remaining candidates fail to receive the necessary support to be eligible for candidacy.
This constitution is repealed by the National Diet

Article 9. The President shall maintain an obligation to uphold the Shogun in times of unrest unless the determination bonus is determined to be too high by a simple majority of the National Diet. Otherwise, a coup must be immediately launched to reinstate the Shogun as the Head of State


Article 10. The President shall hold an obligation to organize a revolution to dismiss of the Shogun if they are found to be in violation of any section of the Constitution of the State of eJapan
---It will subsequently be the President’s responsibility within seven days of the revolution to organize elections for the new Shogun and reinstall a dictatorship if this mandate not otherwise invalid due to Article 8 of this constitution.

Chapter Six: The Ministers of State

Article 1. The Ministers of State shall be appointed and dismissed at the President's pleasure.

Article 2. The respective Ministers of State shall give their advice to the President, and be held responsible for their counsel.

Article 3. The Ministers of State shall be responsible for their respective appointed ministries and the organizations subordinate to them.

Article 4. The Ministers of State and their respective appointed ministries are allowed to exercise the following functions and powers:
---Adopt administrative measures, enact administrative rules and regulations and issue decisions and orders in accordance with the Constitution and its statutes
---Submit proposals to the National Diet of eJapan
---Lay down the tasks and responsibilities of their ministries and commissions
---Conduct foreign affairs and conclude treaties and agreements with foreign states with the consent of the Diet
---Direct and administer the building of national defence;
---Protect the legitimate rights and interests of eJapanese nationals residing abroad and protect the lawful rights and interests of returned overseas eJapanese
---The exercise of unified leadership over the work of the ministries and commissions
---To direct all other administrative work that does not fall within the jurisdiction of the National Diet, the Shogun, the Country President, and other associated ministries and government commissions
---Examine and decide on the size of administrative organs and, in accordance with the law, appoint, remove and train administrative officers, appraise their work and reward or punish them to operate said organs
---Exercise such other functions and powers as the National Diet of eJapan or the Country President may assign them.

Article 5. The Ministers of State are responsible, and report on their work, to the President and National Diet of Japan

Article 6: The Ministers of State will assume a term that is no longer than the day proceeding the country elections to the same day during the next cycle of country elections unless dismissed by the President.
